By booking a fishing charter, submitting a deposit, or boarding a vessel operated by Walker Sport Fishing, you (“Guest”, “Charterer”, “you”) agree to be bound by these Terms & Conditions. If you do not agree, you must not book or participate in any charter experience.
2.1 Reservation Confirmation
Your charter date and time are not guaranteed until you receive a written or electronic confirmation from Walker Sport Fishing. We reserve the right to refuse or cancel any booking at our discretion.
2.2 Deposits
A deposit may be required at the time of booking to secure your charter. Deposit amounts, due dates, and payment methods will be stated during the booking process or in your confirmation communication.
2.3 Balance Due
Unless otherwise specified in writing, the remaining balance is due prior to departure on the day of your charter. Failure to pay the balance when due may result in cancellation of your trip and forfeiture of any deposit paid.
2.4 Pricing
Prices are subject to change without notice prior to booking confirmation. Once your charter is confirmed, the quoted rate will be honored, unless you request changes that affect duration, number of guests, or services provided.
3.1 Guest Cancellations
If you need to cancel or reschedule, you must contact us as soon as possible. Specific cancellation windows, fees, and refund eligibility may vary by charter type and will be provided during booking. Failure to provide sufficient notice may result in forfeiture of your deposit and/or full charter fee.
3.2 No-Shows & Late Arrival
If you fail to arrive by the scheduled departure time, or do not appear for your charter, this will be treated as a no-show and may result in forfeiture of all payments. Late arrival may reduce your fishing time, and the trip may still end at the originally scheduled time.
3.3 Operator Cancellations
Walker Sport Fishing reserves the right to cancel any charter due to unsafe conditions, mechanical issues, captain illness, or other circumstances beyond our control. In such cases, you will be offered the option to reschedule or receive a refund of amounts paid for the affected charter, as our sole obligation and your exclusive remedy.
4.1 Weather Decisions
Fishing is a weather-dependent activity. Final decisions regarding weather-related cancellations or route changes are made solely by the captain, based on safety, comfort, and local conditions. Overcast skies or light rain may not be grounds for cancellation.
4.2 Safety Rules
For the safety of all guests and crew, you agree to follow the captain’s and crew’s instructions at all times, including but not limited to life jacket use, movement on the vessel, handling of rods and tackle, and fish handling. Failure to follow safety instructions may result in early termination of the trip without refund.
4.3 Captain’s Authority
The captain has full authority over the vessel and all persons on board. The captain may terminate or modify the charter at any time if, in their sole judgment, guest behavior, weather, or other conditions create safety risks or violate applicable laws or regulations.
By participating in a charter with Walker Sport Fishing, you agree to the following responsibilities:
6.1 Inherent Risks
Boating and fishing involve inherent risks, including but not limited to slips and falls, rough seas, hooks, sharp equipment, sun exposure, and unpredictable weather or marine conditions. By participating, you knowingly and voluntarily assume all such risks on behalf of yourself and any minors in your party.
6.2 Release of Liability
To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless Walker Sport Fishing, its owners, captains, crew, employees, and affiliates from any and all claims, damages, losses, injuries, or expenses (including attorneys’ fees) arising out of or related to your participation in any charter, except to the limited extent caused by our gross negligence or willful misconduct.
6.3 Limitation of Damages
In no event shall Walker Sport Fishing be liable for any indirect, incidental, consequential, special, or punitive damages. Our total aggregate liability for any claim arising out of a charter shall not exceed the total amount paid by you for the applicable charter.
7.1 Licenses & Compliance
Guests are responsible for obtaining and carrying any required fishing licenses, stamps, or permits, unless explicitly stated otherwise in your booking confirmation. All fishing activities will be conducted in accordance with applicable federal, state, and local laws and regulations.
7.2 Catch Limits & Keep / Release
Bag limits, size limits, and species restrictions are strictly enforced. The captain has final authority on which fish may be kept, released, or used as bait, in accordance with regulations and ethical fishing practices. Violations may result in early termination of the trip without refund.
From time to time, photos or videos may be taken on board for promotional or educational purposes. By participating in a charter, you grant Walker Sport Fishing a non-exclusive, royalty-free license to use such images or recordings that incidentally include you or your party, in any media, unless you notify us in writing prior to departure that you do not consent.
We collect and use personal information you provide during inquiries and bookings to operate our business, manage your charter, and communicate with you.
